It shall be unlawful for any person under the age of 18 years to operate a motor vehicle or ride in or on a motor vehicle in any of the places set forth in SMC 8.48.010 between the hours of 11:00 p.m. and daylight of the following day, unless said minor is accompanied by his or her parent, legal guardian, or other person having the legal custody and control of such person. The provisions of this section shall not apply to any such person who shall be operating or riding in a motor vehicle engaged in gainful employment, or upon an emergency errand, or on legitimate business directed by his or her parent, guardian, or other adult person having the care and custody of such person. The police are authorized to impound any motor vehicle which is being operated or used in violation of this chapter. Upon such action, appropriate notification shall be given as required by the Vehicle Code of the State of California. Each violation of the provisions of this section shall constitute a separate offense.
